Welcome to Topdeck USA. These Terms of Service (“Terms”) govern your use of our website and your purchase of products from Topdeck USA (“we,” “our,” or “us”). By accessing our website, placing an order, or using our services, you agree to these Terms.
1. Online Store Terms
By using our Site, you represent that you are at least the age of majority in your state or jurisdiction, or that you have permission from a parent or legal guardian where required.
You may not use our products or services for any unlawful or unauthorized purpose or violate any applicable laws while using our Site.
2. Products and Collectibles
Topdeck USA sells trading cards, professionally graded trading cards, collectibles, and related products.
Graded cards may be authenticated and graded by independent third-party grading companies such as PSA, CGC, BGS, or other grading services. Topdeck USA does not control or guarantee the grading standards, opinions, population reports, or future decisions of third-party grading companies.
Grades represent the opinion of the applicable grading company and do not guarantee the current or future market value of a card.
Product images and descriptions are provided as accurately as reasonably possible. Colors and appearance may vary depending on lighting, photography, and your display.
3. Mystery Products
Topdeck USA may offer mystery trading-card or collectible products. Mystery products contain an element of chance, and the exact item received is not known before opening or fulfillment.
Unless explicitly stated otherwise, images of potential pulls, featured cards, or examples are illustrative of items that may be available and do not guarantee that a customer will receive a particular card, character, grade, grading company, set, or market value.
Every mystery product will contain the product or number of products specified in its listing.
Market prices for trading cards and collectibles fluctuate. Any estimated values displayed by Topdeck USA are provided for informational purposes only and are not guarantees of resale value, future value, or the amount another person or marketplace will pay for an item.
4. Pricing and Payments
Prices are displayed in U.S. dollars unless otherwise stated.
We reserve the right to change product prices at any time before an order is completed.
Applicable sales taxes, shipping charges, and other charges will be displayed during checkout where required.
We reserve the right to cancel or refund orders resulting from obvious pricing errors, technical errors, suspected fraud, or unauthorized transactions.
5. Orders
We reserve the right to accept, reject, limit, or cancel an order when reasonably necessary, including because of inventory errors, suspected fraud, payment issues, pricing errors, or other circumstances affecting our ability to fulfill the order.
If we cancel an order after payment has been collected, the applicable amount will be refunded to the original payment method.
6. Shipping and Delivery
Customers are responsible for providing a complete and accurate shipping address.
Delivery dates are estimates and are not guaranteed. Topdeck USA is not responsible for delays caused by shipping carriers, weather, incorrect addresses, or circumstances outside our reasonable control.
Customers should contact us promptly if an order arrives damaged, appears to have been lost, or contains an incorrect product.
7. Returns and Refunds
Returns and refunds are governed by our posted Return and Refund Policy.
Because trading cards and collectibles can fluctuate in market value, eligibility for returns may be limited. Mystery products that have been opened, revealed, or otherwise used may not be eligible for return except where required by law or where the product received was incorrect or materially different from the order.
Nothing in these Terms limits rights that cannot legally be waived under applicable consumer-protection laws.
8. Market Values and Investment Disclaimer
Trading cards and collectibles can increase or decrease significantly in value.
Any market values, recent sales, comparable sales, price guides, or estimated values displayed on our Site are provided for informational purposes only.
Topdeck USA does not guarantee that any product can be resold for a particular amount and does not provide financial or investment advice.
9. Third-Party Grading and Authentication
Topdeck USA may sell products authenticated or graded by independent third parties.
We are not affiliated with or responsible for the grading standards, authentication decisions, grade changes, population reports, labeling errors, or other actions of third-party grading companies unless expressly stated otherwise.
10. Intellectual Property
All original content appearing on the Topdeck USA website, including our branding, graphics, photographs, text, website design, and logos, is owned by or licensed to Topdeck USA unless otherwise stated.
Third-party trademarks, product names, characters, logos, and brands remain the property of their respective owners.
References to third-party brands are used solely to identify or describe products and do not imply sponsorship, endorsement, or affiliation unless expressly stated.
11. Prohibited Uses
You may not use our Site to engage in fraud, interfere with the operation or security of the Site, attempt unauthorized access to systems or accounts, distribute malicious software, violate applicable laws, or infringe the rights of others.
